VideoQuiz — the YouTube quiz generator for ESL teachers

1. Acceptance of these terms

By installing or using VideoQuiz ("the Service"), you agree to these Terms of Service. The Service is operated by Tu Anh Tran, an individual based in Hanoi, Viet Nam ("I", "me", or "my").

If you do not agree with these terms, do not install or use the Service.

2. What the Service is

VideoQuiz is a Chrome extension that reads the captions of a YouTube video you choose and uses artificial intelligence to draft a quiz from them. The Service is provided "as is" and "as available".

The Service is an independent tool. It is not affiliated with, endorsed by, or sponsored by YouTube, Google, or OpenAI.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have permission from a parent or guardian.

4. Your OpenAI account

The Service generates quizzes using your own OpenAI API key. You are responsible for:

• Obtaining and securely holding that key
• Keeping billing enabled on your OpenAI account
• All charges OpenAI makes to your account for using the Service
• Complying with OpenAI's own terms of use and usage policies

I am not a party to your agreement with OpenAI and I have no ability to refund, adjust or influence charges made to your OpenAI account.

5. Plans, billing and refunds

5.1 Free plan

The Free plan allows 3 quizzes per calendar month, with up to 5 questions per quiz. No payment information is required and no account is created.

5.2 Pro plan

The Pro plan ($9.99/month) is intended to include no monthly limit for normal teaching, up to 20 questions per quiz, all question types, and every export format. It is subject to a fair-use limit of 30 quizzes per day and 400 per month, which exists to prevent automated abuse; normal classroom use is far below this.

5.3 Billing

When Pro launches, subscriptions will be billed monthly through Lemon Squeezy, acting as Merchant of Record. The Merchant of Record is the seller of record: it processes the payment, issues your receipt, and handles all sales tax and VAT compliance worldwide.

5.4 Cancellation

You will be able to cancel at any time from the link in your receipt or from the customer portal operated by the Merchant of Record. Cancelling stops future renewals; it does not retroactively refund the current period unless the refund policy below applies.

5.5 Refunds

30-day money-back guarantee. If you are not satisfied, contact me within 30 days of purchase and I will arrange a full refund of that payment.

5.6 Your statutory rights

Nothing in these Terms limits or excludes any right you have as a consumer under the mandatory law of your country of residence, including your right to a remedy for faulty digital content and, where applicable, your right to cancel a digital purchase within 14 days. If any part of these Terms conflicts with those rights in your country, those rights prevail over the conflicting part.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Use the Service to create content that is hateful, harassing, discriminatory or otherwise harmful
• Circumvent, disable or tamper with the Free plan limits, the licence check, or any other technical restriction
• Copy, redistribute, resell or sublicense the Service or its source code, or make it available to others as your own product
• Share a licence key with anyone else, or activate it on more devices than your licence permits
• Use the Service in a way that breaches YouTube's Terms of Service or OpenAI's usage policies
• Use automated means to generate content at a volume that degrades the Service for others

7. Licence and intellectual property

7.1 Your content

You own the quizzes you generate. You may use, edit, print, distribute and sell them however you like, including commercially. I claim no ownership over your quizzes and no licence over them.

7.2 My content

The Service itself — its code, design, name, logo and branding — is owned by Tu Anh Tran and protected by copyright and other intellectual property laws. These Terms grant you a personal, non-exclusive, non-transferable licence to use the Service; they do not transfer ownership of anything.

7.3 Open source components

The Service is built entirely from original code and contains no third-party runtime libraries. Its PDF writer, caption parsers and exporters are original work.

9. Availability and changes to the Service

The Service depends on YouTube's caption data and on OpenAI's API, both of which are outside my control. Caption extraction may stop working when YouTube changes its website, and I may need time to fix it. I do not guarantee uninterrupted or error-free operation, and I may modify, suspend or discontinue any part of the Service at any time.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. I DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here excludes or limits any warranty that cannot lawfully be excluded.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Tu Anh Tran, AN INDIVIDUAL DOING BUSINESS AS VIDEOQUIZ, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• (a) your use of, or inability to use, the Service;
• (b) any conduct or content of any third party on the Service;
• (c) any content obtained from the Service; and
• (d) unauthorised access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL TU ANH TRAN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO TU ANH TRAN DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WHERE YOU HAVE PAID NOTHING — AS IS THE CASE FOR ALL USERS TODAY — THAT AMOUNT IS ZERO.

Nothing in this section limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnification

You agree to indemnify and hold harmless Tu Anh Tran from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your use of the Service, the content you generate with it, or your breach of these Terms.

13. Termination

You may stop using the Service at any time by uninstalling the extension. I may suspend or terminate access to any paid feature, without notice, if I reasonably believe you have breached these Terms — for example by sharing a licence key or circumventing plan limits. Where you have paid for a period that is cut short by termination for a breach you did not commit, I will refund the unused portion.

14. Third-party services

The Service interoperates with services I do not control:

Your use of those services is governed by their terms, not by mine, and I am not responsible for their availability or conduct.

15. Governing law and disputes

These Terms are governed by the laws of the Socialist Republic of Viet Nam, without regard to conflict-of-law provisions. Any dispute shall be brought in the courts of Hanoi, Viet Nam.

If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your own country, and you may also be entitled to bring proceedings in your local courts.

16. Changes to these terms

I may update these Terms. If a change is material, I will update the "Last updated" date above and, for paid subscribers, give reasonable notice by email before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.

17. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
